When Gabriel Fernandez was rushed to a hospital in Lancaster in 2013 he was unconscious and showed signs of abuse and torture.
Prosecutors say Gabriel had bruises and cigarette burns all over his body, his skull was fractured, several ribs were broken and the 8-year-old was found to have BB pellets embedded in his groin.
More than 14 months after his death, Gabriel's mother, Pearl Sinthia Fernandez and her boyfriend, Isauro Esperanza Aguirre pleaded not guilty Wednesday to capital murder charges.
Prosecutors have not decided whether to seek the death penalty.
